BOSTON — A Boston woman facing charges for allegedly pushing an elderly passenger off an MBTA bus returned to court Friday, where dramatic surveillance footage of the incident was presented. Luz Pineda, 32, appeared in Roxbury District Court for a pre-trial hearing nearly two weeks after she was arraigned on charges of assault and battery against a senior citizen.
During the hearing, Pineda pleaded guilty as part of a deal that includes two years of probation, a three-month period of home confinement, mandated anger management sessions, and a ban on using the MBTA during her probation. Additionally, she is required to maintain distance from the victim involved in the case. The judge opted for a continued finding, meaning the case will be reviewed after two years.
The incident occurred on September 8 when Pineda allegedly shoved the 63-year-old victim, causing her to fall face-first onto the pavement. The confrontation took place at the intersection of Martin Luther King Jr. Boulevard and Warren Street, capturing the attention of transit police who arrived at the scene to find the victim suffering from facial injuries.
In court, a video from a different angle showed Pineda pushing the victim’s shopping cart off the bus before the shove. This footage has since gone viral on social media, raising public awareness and concern regarding safety on public transportation.
Authorities reported that after the incident, Pineda attempted to alter her appearance to evade identification but was eventually recognized and arrested with help from the community. Prosecutors indicated she had been manipulating her look in an effort to avoid accountability.
The victim sustained various injuries, including a concussion, which has left her with no memory of the events surrounding the attack. Injuries to her eye also required medical treatment.
Pineda’s attorney noted that she was traveling home from a medical appointment for her premature infant when the altercation occurred, suggesting that the victim was obstructing her exit from the bus. The defense aimed to provide context for Pineda’s actions during the incident.
