Queens, New York – Two men have been indicted by a grand jury in connection with the fatal shooting of NYPD Detective Jonathan Diller from Massapequa Park, officials revealed on Monday. Guy Rivera, 34, who allegedly shot Diller during a traffic stop, faces charges of first-degree murder, second-degree murder, weapons offenses, and other crimes. Lindy Jones, 41, Rivera’s alleged accomplice and driver of the car involved in the shooting, was charged with weapons possession offenses related to a handgun found in the vehicle’s glove compartment.
The incident occurred as Diller, part of a community response officers detail, approached Rivera in a Kia during a traffic stop outside 1919 Mott Avenue. After an altercation, Rivera shot Diller in the abdomen, fatally injuring him. Forensic analysis of the weapons used in the shooting revealed no previous connection to other crimes in New York City. During a court hearing for Jones, it was disclosed that Rivera also faces charges of attempted first-degree murder of another officer.
Jones, previously convicted of attempted murder, had his bail revoked due to flight risks associated with the new charges. Defense attorney Murray Singer offered no comments on the case. While Jones made incriminating statements following his arrest in 2023, he was not charged in Diller’s death. Rivera, wounded and in stable condition after being shot by police, is set to appear in court on May 7.
In a statement outside the courtroom, Queens District Attorney Melinda Katz emphasized the importance of holding those who harm police officers accountable. Police Benevolent Association president Patrick Hendry condemned the fact that Jones, a known criminal, was previously arrested for illegally possessing firearms and questioned why he was free. Diller, survived by his wife and young son, was laid to rest following a promotion to the rank of detective.
