Stranger slashes mans’s throat on Miami Beach for refusing to give him a cigarette

MIAMI BEACH, FL – A casual stroll by the shore turned violent for one man after a seemingly routine request for a cigarette ended with his throat slashed, authorities say.

The incident happened late in October near the busy intersection of Collins Avenue and the iconic lifeguard towers that dot Miami Beach. According to investigators, a 24-year-old man identified as Jack Daniel Gutierrez approached a beachgoer and asked for a cigarette. When the request was denied — along with a follow-up attempt to borrow the man’s cellphone — the situation took a dark turn.

What initially appeared to be just another day at the beach quickly spiraled. The victim, having assumed the brief exchange was over, relaxed near the sand. But just moments later, he was allegedly attacked from behind. Reports detail that Gutierrez used a sharp object to cut the victim’s neck, catching him completely off guard.

As the assailant fled the scene, the wounded man realized the severity of his injuries. Blood poured from a deep laceration stretching from ear to ear, officials said. Despite his critical condition, the victim managed to use the voice activation feature on his cellphone to call for help, demonstrating clear-headedness in the face of trauma.

First responders found him struggling but alive, and he was rushed to a nearby hospital. Medical staff worked to contain the bleeding and stabilize the man. His current medical condition has not been released by authorities, but law enforcement confirmed he later assisted in identifying his attacker through police procedures.

Gutierrez, who fled after the assault, was tracked down by officers after an investigation and arrested several days later. Court documents indicate Gutierrez was already on probation for a weapons offense at the time of the alleged attack, raising further concerns about his compliance with release terms.

The suspect now faces charges of aggravated battery with a deadly weapon, a serious felony in Florida, particularly given the extraordinary level of harm involved. According to jail records, Gutierrez is being held without bond at the Turner Guilford Knight Correctional Center.
