Jok Gar, aged 21, was sentenced to two years in prison last December for an unprovoked attack where he and another individual brutally beat a man in Melbourne and stole his phone, utilizing a knife in the process. The victim sustained facial wounds and a partially severed earlobe during the September 6, 2022, incident, which left him unconscious.
Gar’s accomplice, Tyler De Silva, received a lighter sentence of six months due to intellectual disability, childhood epilepsy, and neglect issues in his upbringing. Despite an appeal citing discrepancies in their sentences, Supreme Court justices Karin Emerton and David Beach deemed Gar’s original punishment as lenient. The judges characterized the attack as dangerous and callous, highlighting Gar’s history of random violence in Melbourne.
Following a hearing on April 16, Gar was informed of the cancellation of his refugee visa received in 2009. Despite legal efforts to reverse the visa cancellation to avoid deportation post-incarceration, judges Emerton and Beach saw no merit in reducing Gar’s sentence based on potential burdens during his imprisonment. They pointed out Gar’s violent criminal record, including previous assaults in 2023 and early 2022.
Gar’s behavior in prison led to a reclassification from medium to maximum security, involving assaults on inmates, fights, verbal abuse, and even spitting on guards. Incidents such as stomping on another prisoner and pouring milk and urine under an inmate’s cell door have contributed to his maximum-security status. Born in Egypt to Sudanese parents and arriving in Australia at six years old, Gar’s actions have placed his residency status in jeopardy, pending further legal proceedings.
